Robbery and Burglary Convictions Carry Stigma

What Is the Difference Between Theft, Robbery and Burglary?

Theft is a property crime in which you are accused of stealing or taking the property of another by fraud. In Colorado, penalties for theft crime convictions are based on the amount of property you are accused of taking. Theft of a property that is valued less than $500 is a misdemeanor.

Robbery, a felony, differs from theft in that force or the threat of force is used to take the property. Robbery charges can be aggravated or elevated if you had a weapon in your possession or the victim was seriously injured.

Burglary is defined as breaking and entering of a residence with the intention of committing a crime. Like robbery, burglary is a felony charge. A conviction usually results in significant prison time.

Police sometimes overcharge suspects in order to intimidate them into accepting a plea for a lesser charge. For example, one of my clients was accused of assaulting his girlfriend in her apartment. Because she had asked him to leave, he was charged with burglary in addition to assault. As his lawyer, I had to fight those charges aggressively to keep my client from having a felony on his record.

Early Investigation Is Important

Early investigation of theft, robbery and burglary charges is important for your defense. Witnesses may have a motive to misrepresent facts against you, and those misrepresentations can be costly in terms of the consequences you face.

Immigration consequences of a theft, burglary or robbery conviction: If you are an immigrant and are convicted of robbery, burglary and certain theft charges, you could be subject to deportation. As your lawyer, I will work hard to protect your immigration status.
